As Counsel II, Advertising and Claims Counsel, you'll be responsible for assessing, evaluating, and reviewing advertising to ensure that all claims are truthful, accurate, non-misleading, and adequately supported by appropriate evidence. You’ll partner closely with our Regulatory, Clinical, and Growth and Marketing teams to evaluate proposed claims, assess supporting  documentation, identify potential legal and regulatory risks, and provide guidance on the appropriate use of claims across consumer-facing materials across the full spectrum of platforms, including  websites, social media, podcasts, billboards, and TV. You have a strong knowledge of FDA and FTC advertising regulations and cases, and particularly with respect to prescription drugs and health products. You're smart, collaborative, and comfortable working in a dynamic environment while handling several projects at the same time.

What You’ll Do:

  • Serve as an internal subject matter expert on  FTC and FDA advertising and marketing issues as they pertain to health products.
  • Review and advise on product claims and claim substantiation including scientific studies, clinical data, consumer perception research, product testing, and other supporting evidence to assess the level of support required for proposed claims and evaluate regulatory and legal risk.
  • Sit on Ro’s collaborative medical-legal-regulatory-marketing review team to support advertising review.
  • Assess the legal and regulatory risk associated with proposed claims and recommend appropriate revisions, qualifications, or additional substantiation.
  • Collaborate with cross-functional teams to support new strategic initiatives and advertising campaigns.
  • Stay abreast of developments in FDA and FTC regulations, state laws,  and industry trends in advertising, and monitor enforcement actions and relevant litigation.
  • Maintain documentation of claim reviews, supporting evidence, and substantiation assessments.

What You’ll Bring to the Team:

  • Juris Doctor (JD) from an accredited law school.
  • Active member in good standing of a state bar association.
  • 5+years of experience advising on product claims and claim substantiation of FDA-or FTC-regulated products.
  • Demonstrated experience evaluating scientific and clinical evidence to substantiate advertising claims, including assessing study design, endpoints, statistical findings, and the extent to which evidence supports proposed consumer-facing claims.
  • Strong knowledge of FTC advertising substantiation standards, including express and implied claims, competent and reliable scientific evidence, comparative advertising, misleading net impression, influencer advertising, and pricing laws.
  • Familiarity with FTC enforcement actions, Lanham Act challenges, consumer false advertising litigation, and NAD proceedings.
  • Exceptional analytical, research, and writing skills.
  • Strong communication and interpersonal skills, with the ability to build relationships across all levels of the organization.
  • Business-oriented mindset with the ability to translate legal advice into practical solutions.
  • Adaptable and able to thrive in a fast-paced, dynamic environment.
  • Self-starter with the ability to manage multiple projects simultaneously and meet deadlines.
  • Passion for the telehealth industry and a desire to make a meaningful impact.

We’ve Got You Covered:

  • Full medical, dental, and vision insurance + OneMedical membership
  • Healthcare and Dependent Care FSA
  • 401(k) with company match
  • Flexible PTO
  • Wellbeing stipend
  • Paid parental leave + Fertility benefits
  • Pet insurance
  • Student loan refinancing
  • Virtual resources for mindfulness, counseling, and fitness
  • We welcome qualified candidates of all races, creeds, genders, and sexuality to apply.

The target base salary for this position ranges from $170,000-$215,000, in addition to a competitive equity and benefits package (as applicable).
